TIMBERLAND DOCUMENTARY SCREENING SWEEPSTAKES

Open only to legal U.S. residents who meet all of the following criteria:

1. are Timberland Community members as of October 6, 2023;
2. live in the New York City Metropolitan Area (defined as: the following counties in New York State- Bronx, Kings, Nassau, New York, Queens, Richmond, Rockland, Suffolk and Westchester; New Jersey – Bergen, Essex, Hudson, Mercer, Middlesex, Monmouth, Morris, Ocean, Passaic, Somerset and Union; Connecticut – Fairfield and New Haven); 
3. who are 18 years of age or older; and
4.  who received the Sweepstakes e-mail invitation directly from Sponsor on October 6, 2023†.

Offered only in the New York City Metropolitan Area. Void elsewhere and where prohibited by law. 

Internet access and valid e-mail address required.

By participating in the Sweepstakes, you agree to these Official Rules as well as the decisions of Sponsor which are final and binding in all respects.

†Even if a person receives the October 6 Sweepstakes e-mail invitation from Timberland, they may not be eligible for the Sweepstakes.

1. Sweepstakes Period.

Sweepstakes Period begins at or about 2:00p.m. Eastern Time (ET)** on October 6, 2023 and ends at 11:59:59 a.m. (ET) on October 9, 2023. Timberland’s computer is the official clock for the Sweepstakes.

**Actual start time on October 6 depends on when Sponsor sends out the e-mail invitation.

1. Sweepstakes Eligibility.

The following persons are NOT eligible to enter the Sweepstakes:  

1. Employees, officers, directors, independent contractors (including influencers and endorsers) of Timberland, its parent, affiliates, subsidiaries, divisions, related companies, agencies and prize suppliers (collectively, the “Sweepstakes Entities”);
2. Any member of the immediate family (parent, child, sibling, spouse) of any person in the preceding category, regardless of where they live; and
3. Any member of the same household of any person in category (a), whether related or not.

1. How To Enter.  

Sponsor will send a Sweepstakes e-mail invitation to Timberland Community members on October 6, 2023 as discussed above. Click on the link in the e-mail and then complete official entry form with all required information (including your first name, last name, e-mail address and zip code) in order to enter the random drawing.

There is a limit of one (1) entry per person.

Receipt of entry may be acknowledged, but any such acknowledgment does not constitute any representation of eligibility for Sweepstakes nor is it otherwise binding upon Sponsor in any respect.

Proof of transmission of official entry form does not constitute proof of receipt of same or proof of entry in the Sweepstakes.

Participation via mobile device may result in imposition of wireless Internet access charges and perhaps other fees.  Be sure to check your wireless carrier’s pricing plan BEFORE entering the Sweepstakes via mobile website. Not all mobile devices offer wireless Internet functionality; and, wireless Internet access may not be available in all areas. 

In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the Authorized Account Holder of the e-mail account provided on the entry form who must be the Timberland Community member who received the Sweepstakes e-mail invitation directly from Sponsor on October 6 (as well as otherwise being eligible for the Sweepstakes as set forth above). Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. SWEEPSTAKES E-MAIL INVITATION IS ONLY VALID FOR THE TIMBERLAND COMMUNITY MEMBER WHO WAS THE ORIGINAL, INTENDED RECIPIENT OF SAME AND IS VOID IF FORWARDED/TRANSFERRED BY SUCH ORIGINAL, INTENDED RECIPIENT TO ANOTHER PERSON.

1.  Selection & Notification Of Winners.

Winners will be selected via random drawing by Sponsor on or about October 9, 2023 after 11:59:59 a.m. (ET).  The random drawing will consist of all eligible entries received.

Potential winners will be notified via e-mail. It is recommended that you check your e-mail for such notification being at approximately 12:15 p.m. (ET). Sponsor will use commercially reasonable efforts to notify potential winners but expressly disclaims any and all liability in conjunction with lost, late, delayed, corrupted undeliverable e-mails (including due to filtering by an individual’s e-mail service provider).

Potential winner may be required to complete, sign and return a Declaration of Eligibility, a Liability Release and a Publicity Release (where lawful) as a condition of accepting the prize. Failure to timely return the completed and signed Declaration/Release (if applicable) or if potential winner cannot be contacted for any reason; or, if potential winner is determined by Sponsor to be ineligible or not in full compliance with these Official Rules, will result in prize forfeiture without compensation and an alternate potential winner may be selected (time permitting).

1. Prizes/Odds.

Prizes (5) – admission for winner and one (1) guest (who must be 18 years of age or older) to a screening of the Timberland Documentary (“Screening”) in New York, New York on Wednesday, October 11, 2023.  Screening will be followed by a panel discussion with talent from the documentary film (“Film Talent”) and other special guests, at which non-alcohol beverages and snacks will be served.  Approximate Retail Value: $200 each. Total Approximate Retail Value of All Prizes: $400.

Winner must be able to attend Screening on October 11. If winner is not able to do so for any reason, the Grand Prize will be forfeited without compensation of any kind and alternate winner may be selected (time permitting).

Screening is offered subject to availability and other restrictions.

Attendance of Film Talent and other special guests at Screening is subject to their availability and not guaranteed.  Should Film Talent and/or other special guest(s) not be available as intended for any reason, Sponsor’s liability will be limited to award of the remaining elements of the Prize.  Film Talent and other special guests may (or may not) sign autographs or pose for videos/photos (“selfies”) with winner and guest at their sole discretion; and, should Film Talent and/or other special guest(s) choose not to do so for any reason, Sponsor shall not have any liability of any kind.

Winner and guest must at all times act in an appropriate, well-behaved and respectful manner when attending the Screening.  Without limiting any of the foregoing, winner and guest understand and agree that:

1. Sponsor, venue hosting the Screening as well as Film Talent and other special guests may require the winner and guest to practice social distancing, wear a mask, provide proof of a negative COVID-19/Coronavirus test and/or provide proof of vaccination against COVID-19/Coronavirus; the preceding is in addition to compliance with all applicable laws designed to prevent the transmission of COVID-19/Coronavirus, to which winner and guest are also bound.

1. They must treat Film Talent and other special guests with courtesy and respect at all times and, without limitation, not antagonize, insult or verbally abuse them.

1. They must not be intoxicated, in possession of a firearm or otherwise pose a security risk or engage in other disruptive actions in conjunction with attending the Screening. They agree to a security screening of their persons and property as a condition of admission to the Screening.

1. They must wear appropriate attire and refrain from recording the documentary film.    

Violation of the preceding may result in denial of admission to (or ejection from, as the case may be) the Screening, in which case Sponsor will not have any liability of any kind.

It is the winner’s sole responsibility to advise Sponsor of any dietary restrictions affecting winner and/or his/her guest. While Sponsor will use commercially reasonable efforts to accommodate such dietary restrictions, Sponsor disclaims any and all liability in conjunction therewith.

All costs and expenses not specified in these Official Rules as well as any applicable taxes on the value of the prize are the winner’s sole responsibility including travel to/from Screening, parking in New York, New York, any desired overnight hotel stay in New York, New York and incidentals. Prize must be accepted as set forth herein.

Guest may be required to sign and return a Liability Release and Publicity Release (where lawful) prior to the Screening.  

Should winner choose to accept the prize without a guest (or if guest fails to timely return signed Liability/Publicity Release, if applicable), the winner will receive only one (1) admission to the Screening and no alternate prize or compensation will be awarded.

Limit of one (1) prize per person, family, address or household.

No prize substitution permitted except by Sponsor due to unavailability of prize and only then for prize of equal or greater value. Prizes are not transferable except with the prior consent of Sponsor which may be granted or withheld in its sole discretion. Prizes are not redeemable or exchangeable for cash.

Odds of winning depend on the number of eligible entries received.

1. Releases.

Where legal, by accepting prize, winner agrees to the use of their name, likeness, photo, voice, biographical information, image and other indicia of their persona/identity by Sponsor for advertising/publicity/trade purposes without further compensation or notice.

By participating in the Sweepstakes, entrant releases and agrees to hold harmless Sweepstakes Entities and each of their respective directors, officers, agents, representatives, shareholders, employees, successors and assigns, from any and all liability arising from the Sweepstakes or acceptance, possession, receipt or use/misuse of prize (if applicable).

1. Conditions of Participation. 

Sweepstakes Entities are not responsible for entries or Sweepstakes e-mail invitations that are late, lost, garbled, incomplete, inaccessible/blocked, corrupted, jumbled, misdirected, delayed or damaged, regardless of cause, all of which are void; for technological, programming, electronic, or other error/malfunction/failure of any kind which interferes with the advertising/offering of the Sweepstakes in any respect. Sponsor disclaims any liability under any legal theory for errors of any kind in the design or implementation of the Sweepstakes.  Sponsor’s failure to enforce any provision of these Official Rules in a given instance shall not constitute the waiver of such provision.

TAMPERING WITH THE SWEEPSTAKES, INTERFERING WITH THE INTENDED OPERATION OF THE SWEEPSTAKES OR SEEKING TO DEFRAUD TIMBERLAND IN CONJUNCTION WITH THE SWEEPSTAKES (INCLUDING MISBEHAVIOR BY WINNER OR GUEST AT SCREENING) WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES  (IF APPLICABLE) WITHOUT LIABILITY OF ANY KIND TO SPONSOR.  IN ADDITION, SHOULD A PERSON SUSPECTED OF SUCH CONDUCT BE A MEMBER OF THE TIMBERLAND COMMUNITY, THEIR MEMBERSHIP IS SUBJECT TO TERMINATION PURSUANT TO SECTION 6 OF THE TIMERLAND COMMUNITY TERMS. SPONSOR FURTHER RESERVES THE RIGHT TO PURSUE LEGAL SANCTIONS AGAINST ANY PERSON SUSPECTED OF ENGAGING IN SUCH CONDUCT. 

1. Force Majeure.  

If Sponsor determines in its sole discretion that the Sweepstakes– in whole or in part – is delayed, prevented, made inadvisable or illegal or cannot be conducted as originally planned due to any cause beyond its control, including without limitation, war, invasion, act of foreign or domestic enemy, terrorist threats or acts, hostilities, civil disorder, war or rebellion (whether war be declared or not), shortage of adequate power, computer virus/bug, tampering, fraud, natural disaster, materials, manufacturing capacity or transportation or shipping facilities, disease, sickness, epidemic or pandemic, government order or law, action by any federal, state or local governmental authority, national or regional emergency, strike, riot, lockout or other industrial dispute, flood, fire, tornado, hurricane, earthquake or explosion, or act of God (each, a “Force Majeure Event”), Sponsor may cancel, modify or suspend the Sweepstakes and, to the extent feasible, determine the prize winners from among all eligible entries received prior to and/or after the action taken by Sponsor or otherwise in a manner that Sponsor in its sole discretion determines is fair, appropriate and consistent with these Official Rules. In such event, Sponsor will advise all Timberland Community members who received the Sweepstakes e-mail invitation of such action via e-mail.

1. Privacy Policy.  Information provided via the official entry form when entering the Sweepstakes is subject to Timberland’s Privacy Policy accessible at https://www.timberland.com/en-us/privacy.

1. Dispute Resolution/Choice of Law.  To the fullest extent permitted by law, by participating in the Sweepstakes, you understand and agree that any claim or dispute regarding the Sweepstakes or these Official Rules will be resolved individually (NOT AS PART OF A CLASS ACTION/PROCEEDING) by means of binding arbitration (NOT IN A COURT OF LAW; THE RIGHT TO A JURY TRIAL IS BEING WAIVED). As fully set forth in the “Disputes and Arbitration Agreement” section of the Terms of Use of the Timberland website (accessible at https://www.timberland.com/en-us/legal/terms-of-use), such arbitration will be conducted by the American Arbitration Association pursuant to the Federal Arbitration Act. As fully set forth in the “Governing Law; Entire Agreement” section of the Terms of Use, the Sweepstakes and these Official Rules will be governed by Delaware law, regardless of choice of law principles.

If the preceding or any other provision of these Official Rules is determined by the arbitrator to be invalid, illegal or unenforceable, it shall be replaced by a substitute provision that most closely approximates the original intent of Sponsor and is valid, legal and enforceable. The invalidity/illegality/unenforceability of a given provision shall not affect the remainder of these Official Rules.

1. Winners’ List.

For winners’ list, send a self-addressed stamped envelope to Sponsor at the above address c/o “TIMBERLAND DOCUMENTARY SWEEPSTAKES WINNERS.” Winners’ list requests must be received by October 25, 2023.  Winners’ list will be available after November 1, 2023.
